Les informations utiles<\/a><\/li><\/ul><\/nav><\/div>\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"1_Avant_lembauche\"><\/span>1. Avant l&#8217;embauche<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Il est possible d\u2019embaucher des mineurs, cependant il existe des r\u00e8gles sp\u00e9cifiques qui leur sont applicables. Lorsque l\u2019on embauche un salari\u00e9, une visite m\u00e9dicale doit avoir lieu dans les 3 premiers mois de l\u2019embauche et avant l\u2019embauche pour les salari\u00e9s mineurs.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>En tant qu\u2019employeur, vous devez tenir \u00e0 jour le registre des salari\u00e9s<\/strong> (qui r\u00e9capitule la vie de l\u2019entreprise).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"_2_La_relation_durant_le_contrat_de_travail\"><\/span>\u00a02. La relation durant le contrat de travail<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Pour un CDI temps complet<\/strong>, il faut pr\u00e9ciser la dur\u00e9e de la p\u00e9riode d\u2019essai (entre 2 et 4 mois en fonction de la nature du contrat, du statut du salari\u00e9 et de la convention collective). Le renouvellement de la p\u00e9riode d\u2019essai n\u2019est possible que si la convention collective le pr\u00e9voit, et doit faire l\u2019objet d\u2019un accord \u00e9crit entre le salari\u00e9 et l\u2019employeur. Un fait \u00e0 garder en t\u00eate : les r\u00e8gles du droit du travail changent en continu, avec une multitude de droits en fonction des conventions collectives. <strong>Concernant le t\u00e9l\u00e9travail, qui s\u2019est d\u00e9mocratis\u00e9 avec la Covid-19, il commence \u00e0 y avoir des jurisprudences.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Il existe plusieurs types de CDD<\/strong>\u00a0: pour surcroit d\u2019activit\u00e9, remplacement de personnes absente, dans l\u2019attente de la prise de fonction d\u2019un salari\u00e9, contrats d\u2019apprentissage, de professionnalisation, contrats aid\u00e9s France Travail. Pour un CDD, il y a des r\u00e8gles \u00e0 respecter, en fonction du secteur d\u2019activit\u00e9 (CDD usage, saisonnier\u2026). Il existe aussi le contrat \u00e0 terme impr\u00e9cis, pour pallier une absence, comme pour un arr\u00eat de travail.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Une chose \u00e0 retenir en tant qu\u2019employeur ? Ne vous fiez pas \u00e0 ce que vous allez trouver sur internet, votre cas est unique et d\u00e9pend de multiples param\u00e8tres.<\/p>\n<cite>M\u00e9lina Chabert Desnots, Juriste en droit social<\/cite><\/blockquote>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"3_La_duree_de_travail\"><\/span>3. <strong>La dur\u00e9e de travail<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Elle est mensualis\u00e9e, avec un lissage de la r\u00e9mun\u00e9ration. <strong>On ne peut pas faire travailler un salari\u00e9 plus de 44h\/semaine sur 12 semaines cons\u00e9cutives et 48h sur une semaine.<\/strong> Pour d\u00e9terminer et calculer les heures suppl\u00e9mentaires, vous pouvez vous rapprocher de votre gestionnaire de paies.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"4_Les_stagiaires\"><\/span>4. Les stagiaires<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Le versement de la gratification de stage est d\u00e9termin\u00e9 sur une ann\u00e9e scolaire, elle est obligatoire d\u00e8s que le stage est sup\u00e9rieur \u00e0 2 mois ou 309h.<\/strong> La gratification se d\u00e9clenche \u00e0 partir de la premi\u00e8re heure, \u00e0 un taux de 4\u20ac35 de l\u2019heure. Le stagiaire n\u2019a pas les m\u00eames droits ni les m\u00eames obligations qu\u2019un employ\u00e9, car il n\u2019a pas le statut de salari\u00e9.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"5_Lentretien_professionnel\"><\/span>5. L&rsquo;entretien professionnel<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Il est obligatoire tous les 2 ans<\/strong>, sauf cas particulier. Il concerne toutes les entreprises et tous les salari\u00e9s. Attention, il faut un \u00e9crit sign\u00e9 et valid\u00e9 par l\u2019employeur et le salari\u00e9.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"6_Laccident_de_travail\"><\/span>6. L&rsquo;accident de travail<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">En priorit\u00e9,<strong> il faut transmettre les informations pour r\u00e9diger la d\u00e9claration d\u2019accident du travail<\/strong>, \u00e0 d\u00e9poser sous 48h, avec une possibilit\u00e9 de d\u00e9p\u00f4t en ligne (net entreprise).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"7_La_rupture_du_contrat_de_travail\"><\/span>7. La rupture du contrat de travail<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Elle peut \u00eatre li\u00e9e \u00e0 un d\u00e9part en retraite, un licenciement (pour faute simple, faute grave ou lourde), une rupture conventionnelle. <strong>En fonction de la nature de la rupture, il y aura indemnit\u00e9 ou non.<\/strong> Un CDD co\u00fbtera g\u00e9n\u00e9ralement plus cher qu\u2019un CDI en cas de rupture. L\u2019employeur, d\u00e8s lors qu\u2019il est \u00e0 l\u2019initiative de la rupture d&rsquo;essai, doit respecter un d\u00e9lai de pr\u00e9venance, apr\u00e8s un mois d\u2019essai, ce d\u00e9lai est de 14 jours.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"8_Les_conges_payes\"><\/span>8. Les cong\u00e9s pay\u00e9s<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>L\u2019entreprise est ma\u00eetre des cong\u00e9s pay\u00e9s<\/strong>, c\u2019est une pr\u00e9rogative employeur. L\u2019employeur a pour obligation de faire prendre 12 jours cons\u00e9cutifs au salari\u00e9 pendant la p\u00e9riode de cong\u00e9s qui s\u2019\u00e9tend du 1<sup>er<\/sup> mai au 31 octobre.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"9_Les_informations_utiles\"><\/span>9. Les informations utiles<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>La convention collective applicable<\/strong> : il faut bien y r\u00e9fl\u00e9chir en amont, car il est tr\u00e8s compliqu\u00e9 d\u2019en changer ensuite.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>La cadence de paiement des salaires doit \u00eatre r\u00e9guli\u00e8re.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Les registres obligatoires<\/strong> : le registre du personnel, du CSE, de s\u00e9curit\u00e9, sp\u00e9cial du repos hebdomadaire\u2026 Consultez le SMIA pour un accompagnement pour une visite de pr\u00e9vention. Le SMIA ou votre expert-comptable peut vous accompagner sur la mise en place du document unique d&rsquo;\u00e9valuation des risques.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Les affichages obligatoires<\/strong> : inspection du travail, A3 \u00e0 afficher dans le bureau.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Les effets de seuil<\/strong> : Chaque franchissement de seuils, d\u00e9termine de nouvelles obligations, 11, 20, 50, 300 salari\u00e9s\u2026Notamment la mise en place d\u2019un CSE \u00e0 partir de 11 salari\u00e9s, l\u2019obligation d\u2019embauche de travailleur handicap\u00e9 \u00e0 partir de 20 salari\u00e9s.
